About This Policy:

This policy provides notice of how JPER Job Placement & Employment Rehabilitation (“JPER”) uses its Website to collect and use information or data collected or gathered from visitors or users to and of the Website.  It applies to the information JPER collects from users or visitors when interacting with the Website.  That applies both to online & offline information collection.  It clarifies how it might be shared and how each visitor or user  can change and / or make their own privacy choices.

  1. Introduction

Importance of Privacy  

Given each person’s need for privacy, and the growing complexity of the industry JPER operates in, this Privacy Policy is mandatory. By providing such a wide range of services, policies concerning the gathering and use of personal information is also required. How JPER gathers and collects personal information, how it is used and stored, and when it gets disclosed and to whom is described in this Privacy Policy.

  1. Personal Information

“Personal Information” includes anything that can identify a visitor or user specifically and individually. Normally, such information is provided directly by the visitor or user or an authorized agent. Contact information (for example, an email address), information that is already available publicly or information that is aggregated or anonymized that nonetheless includes information about a visitor or user is not considered to be personal information.

  1. Consent

By accessing or using the Website, a visitor or user consents to the collection, use, disclosure and retention of Personal Information by JPER. However, a visitor or user can withdraw that consent at any time, subject to legal or contractual restrictions with reasonable notice.  Note that withdrawing consent might inhibit the ability to proceed with intended interactions and transactions with JPER.

  1. What Personal Information Is Collected

Within the scope of dealings with JPER, from the outset and as relationships develop, more and more information will be gathered and stored, per the number of visits. Any information provided on or via the Website is collected and stored. There is no restriction on, to or with the type of information collected or stored.

(a) What Personal Information Can Include

Personal Information includes (but is not restricted to):

  • contact information (such as name, email address, residential address, and phone numbers);
  • identifying information, which includes things like government issued ID, nationality, residence status, occupation, social insurance number, birth date, driver’s license, employment information, educational information, qualifications, background, bank account information and other financial information;
  • information about family and / or close associates, which can include information about a spouse, partner, and other family members; and,
  • correspondence and other communication with and between JPER.

(b) Automated Collection

The Website may automatically collect certain information regarding use by a visitor or user, as dates, times of access, browsers, operating systems, software and devices used to access the Website, along with places visited on the Website and information downloaded from it.

The Website might and can use technologies such as cookies, web beacons, tokens, pixels, or tags to collect information to help improve products, services, communications & advertising, as well as to prevent fraud.   JPER may use information collected through technological means to recognize each visitor or user to improve the Website, to confirm successful delivery of messages and to provide targeted marketing.  

A visitor or user can decline or disable cookies if a web browser or on-line device permits. Additional information on cookies can be found below.

  1. Use of Personal Information

 

(a) Provide Value Adding Products & Services

The nature of products and services offered can be customized. Services are not mass market oriented. That is why obtaining Personal Information is vital to the value and potential success of any product or service offered by JPER.  Some of the reasons Personal Information is collected:

  • to establish and govern JPER’s relationship with a visitor or user;
  • to help maintain contact;
  • to provide a smoother and integrated user experience;
  • to provider better and more efficient interactions;
  • to better target more useful information of interest to a visitor or user (including by email and other electronic messages);
  • to help develop better products and services;
  • to respect legal rights to privacy;
  • to protect the legal rights of JPER; and
  • to comply with legal and regulatory requirements.

(b) Confidential Profile

Each visitor or user may develop and maintain a confidential client profile to use for internal purposes connected to improving overall client experience.

(c) Interest-Based Advertising

As mentioned above, JPER will make use of tracking software like cookies and web beacons to store information about each visitor or user’s use of the Website. However, each visitor or user can opt out of receiving interest-based advertising on a website, social media site or other online services by using advertising preference settings.  

  1. Disclosure of Personal Information

JPER will not disclose or sell to a third-party any Personal Information. However, that will be released if required by a Court Order, government directive or as part of JPER obtaining professional advice.  

(a) Subsidiaries, Affiliates & Business Partners

Personal Information may be shared within subsidiaries and affiliates. That is done as is necessary and needed to provide the products and levels of service required.

(b) Suppliers and Service Providers

Given the nature of the industry, third party storage companies may be engaged to assist with the safe storage and retrieval of Website information. Such third parties include (but are not restricted to) cloud service providers and payment processors. Such entities do have their own confidentiality undertakings, policies, and provisions, which is confirmed on their being retained. JPER does not take or accept any responsibility or liability for any breaches (howsoever arising) of their confidentiality obligations or undertakings.

 

  1. Withdrawal of Consent

A visitor or user can withdraw consent at any time.

  • Withdrawing consent for integral purposes:

A visitor or user may withdraw consent for purposes that are integral to the provision of JPER products and services. However, that might affect the delivery of JPER products and services, or cause them to be denied or withdrawn. 

  • Withdrawing consent for additional purposes:

Other purposes such as advertising, are not integral to the provision of products and services.  Withdrawal of consent for those purposes will not impact the provision of products and services. Withdrawal of consent to Personal Information being used or shared for the following additional purposes is permitted:

  • communications for the purposes of providing advertising and marketing messages pertaining to additional products or services that may be of interest. To opt-out of commercial emails, simply click the link labeled “unsubscribe” at the bottom of any commercial electronic communication that gets sent; and
  • to conduct surveys on the quality of our products and services.

  1. Location of Personal Information

Personal Information is normally stored in Canada.

  1. Retention of Personal Information

Personal Information is stored and kept as data only for the period necessary to fulfill the purpose for which it was collected. However, it is also stored and maintained subject to applicable law. Legal considerations will trump any client withdrawal of consent or demands that Personal Information be deleted or destroyed.

Subject to legal requirements, contractual and other obligations, requests to delete or destroy Personal Information will be done within a reasonable period.  Please note that some information might need to be retained to satisfy legal and security obligations.  For example, some information may remain in back-up storage even if a request is submitted to delete it.

  1. Protection of Personal Information

JPER strives to protect Personal Information against unauthorized access. That includes through maintaining administrative, technical, and physical safeguards to protect Personal Information. While certain risks to the system are unforeseeable the use of industry-standard encryption technology to secure sensitive personal information when it is collected and transmitted over the Internet as well as firewalls, site monitoring and intrusion detection software is used. 

  1. Accuracy and Access to Personal Information

JPER relies on each visitor or user to ensure that Personal Information provided is accurate, complete, and up to date for the purposes of its use.  A visitor or user is being relied upon to promptly notify JPER of any changes to Personal Information provided. 

A visitor or user has the right to access their own Personal Information and to have it corrected. JPER will respond within any time limits required by applicable legislation, and in accordance with any legislated requirements. JPER will not be able to provide access to Personal Information if doing so would infringe the privacy of another person.

  1. Other Websites and Businesses

The Website may include advertisements for products and services offered by third-parties,  independent businesses or via links to websites or mobile apps operated by independent businesses. They also provide useful and educational information. However, JPER takes no responsibility or liability (howsoever arising) for, or control over, those other websites, mobile apps, online services or businesses, their products or services, or their collection, use, disclosure or retention of Personal Information.

Such sites would normally have their own privacy policies. This Privacy Policy does not apply to the collection, use, disclosure, or retention of Personal Information by those websites, mobile apps, online services and independent businesses. Also, JPER cannot and will not be responsible for any breach of privacy laws or rules by any of the aforementioned.

  1. Social Media

The Website may include links to other social media websites. Information posted or shared on them is accessible to other persons and companies, who may and do target visitors.  Social media websites have their own privacy policies and practices.

When a link to a social media website is clicked on, that means departure from the Website. Any information posted or left behind is the sole responsibility of the relevant visitor or user. JPER has no control over, or responsibility, or liability for, the collection, use, disclosure, or retention of the personal information disclosed in those situations, and this Privacy Policy does not apply to the collection, use, disclosure or retention of Personal Information by those websites.   

  1. Children and Personal Information

JPER does not knowingly collect Personal Information from children under 13 years of age without the consent of a legal guardian or authorized agent.

  1. Disclaimers, Liability Exclusions/Limitations and Disputes

Other than for its gross negligence in safely storing and protecting Personal Information as required by relevant legislation, JPER has no and accepts no liability whatsoever, howsoever arising for any injury or harm caused by or through use of the Website.

Under no circumstances whatsoever, or for any reason will JPER accept any liability for any indirect, special or punitive damages, loss or harm, or for loss of wages, employment, opportunity or anything similar to the foregoing.

  1. Changes to this Policy

Continued dealings with or use of the Website after any change to this Privacy Policy will signify consent to the collection, use, disclosure and retention of Personal Information by JPER as set out in the changed Privacy Policy.    

  1. Notice

Use of the Website means consent to JPER sending out emails (to any email address provided) regarding this Privacy Policy and related matters. 

Data Sharing for Google Customer Match

At JPER, we respect your privacy and are committed to protecting your personal data. We may share certain customer data with third parties, including Google, to perform services on our behalf. Specifically, we use Google’s Customer Match campaigns to deliver relevant ads to our audience. The data we share with Google is used solely for matching customers to Google accounts and ensuring compliance with Google’s policies, including the Customer Match Policy and EU User Consent Policy.

We obtain your consent where required by law before sharing data for personalized advertising purposes. Under the General Data Protection Regulation (GDPR), Google acts as a “processor” of the data we provide for Customer Match, and the Google Ads Data Processing Terms apply to this activity. Our account settings are updated with contact information for our primary contact, data protection officer, and/or EU representative, as required.

You have the right to request access, correction, or deletion of your data and to withdraw consent where applicable.
